User Agreement
By viewing this website and requiring services from Mandarinrise, you are indicating your consent to everything in this agreement. Please read it carefully!

General Information
This agreement is the only agreement between Mandarinrise and clients or users of Mandarinrise site, hereafter referred to as “user” or “users”. We reserve the right to change this agreement at any time. Any changes will be indicated on our front page, and by using the site thereafter, the user agrees to the new terms.

Informal Rules of Usage
There are several informal rules of usage at Mandarinrise.
1. You may not misrepresent yourself or your firm.
2. You should inform Mandarinrise of your trip information and itinerary with specific details. This will help us in customizing the best service for you and arranging for you smoothly.
3. While you are with a personal assistant or personal tour guide and you see something improper or disturbing you, inform your assistant or tour guide, they will help to handle the situation.

Eligibility
Our services are available only to individuals and groups who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do not use Mandarinrise.com.

User Conduct
Use of the Service is subject to all applicable local, state, national and international laws and regulations. User must agree (1) to comply with laws of the People's Republic of China (PRC) regarding the transmission of technical data exported from the PRC through the Service, (2) not to use the Service for illegal purposes, (3) not to interfere or disrupt networks connected to the Service; and (4) to comply with all regulations, policies and procedures of networks connected to the Service.

Without limiting any other remedies, Mandarinrise.com may terminate service if user is found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our site. User agrees not to transmit through the Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. User further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to our computer systems are prohibited.

User shall not interfere with another user's use and enjoyment of the Service or another entity's use and enjoyment of similar services.

Mandarinrise.com may, at its sole discretion, immediately terminate user's service if his or her conduct fails to conform with the terms and conditions of this agreement.

System integrity
User shall not use any device, software or routine to interfere or attempt to interfere with the proper working of Mandarinrise.com. User may not take any action which imposes an unreasonable or disproportionately large load on our infrastructure.

Disclaimer of Warranties
User expressly agrees that use of the service is at their sole risk. The service is provided on an “as is” and “as available” basis. Mandarinrise.com expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Mandarinrise.com makes no warranty that the service will meet specific requirements, or that the service will be uninterrupted, timely, secure, or error free; nor does Mandarinrise.com make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained through the service.

Mandarinrise.com makes no warranty regarding any goods or services purchased or obtained through the service or any transactions entered into through the service.

No advice or information, whether oral or written, obtained by user from Mandarinrise.com or through the service shall create any warranty not expressly made herein.

Some jurisdictions do not allow the exclusion of certain warranties, therefore some of the above exclusions may not apply to every customer.

Limitation of Liability
Mandarinrise.com shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or the inability to use the service; for the cost of procurement of substitute goods and services, or resulting from any goods or services purchase or obtained; for messages received or transactions entered into through the service  or resulting from unauthorized access to or alteration of user's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangibles, even if Mandarinrise.com has been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages therefore some of the above limitations may not apply.

Changes in the Service
Mandarinrise.com reserves the right to modify or discontinue services with or without notice to user or other users.

Mandarinrise.com shall not be liable to users or any other third party.

Mandarinrise.com exercises its right to modify or discontinue services.

Indentification
User agrees to indentify and hold Mandarinrise.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees made by any third party due to or arising out of user's use of the Service, the violation of this Agreement, or the infringement by the user or other users of the Service.

Termination
Mandarinrise.com may terminate service with or without cause at any time becoming effective immediately upon termination. Mandarinrise.com shall not be liable to user or any third party for termination of Service.

If user objects to any terms and conditions of this agreement or any subsequent modifications or becomes dissatisfied with the Service in any way, the only recourse is to immediately discontinue use of services.

Upon termination of service, the right to use the service immediately ceases. User shall have no right and Mandarinrise.com will have no obligation thereafter to communicate or disclose information with user or any third party.

Service Details
The service charge does not include any other fee (for example: transaction fee using for payment, transportation fee, meal fee, etc.). User is to be held responsible for all activities within the service duration, like transportation, meals, etc.(for "out-of-town", accommodation costs will be paid by the user).

Personal Assistant, Personal Tour Guide, and Interpreter work time: one day <= 8 hours; minimum-order is one day. Overtime fee for additional work over 8 hours = price per day (8 hours) x 1.5 .

Service Cancellation
To guarantee your booking, full amount of payment is charged at least 7 days before the starting time.

In the event of cancellation , you will receive refund of (cancellation fee will apply) within 14 days of our receipt of a written cancellation request.

The cancellation fee will be calculated as follows:
1. Notice over 20 to 30 days prior to service starting date: 30% of total service charge.
2. Notice 4 to 20 days prior to service starting date: 50% of total service charge.
3. Notice 0 to 3 days prior to service starting date: 70% of total service charge.

Responsibility
The user and Mandarinrise's staff are required to comply with laws of the People's Republic of China and to take full and sole legal responsibility for all and any activities with respect to Mandarinrise's service within China . If user has any illegal requests or requirements (including requesting innapropriate massage services or other lewd activities) with Mandarinrise's service staff at anytime, if user's activities or requests do not comply with laws of the People's Republic of China, or if our service staff doesn't feel safe and secure during service period, Shanghai Mandarinrise has the right to stop the service and is under no obligation to issue a refund for used or unused services.

Mandarinrise.com shall not be responsible for any loss, injury, or damage to client.
Mandarinrise.com shall not be responsible for the theft or loss of valuable items due to client negligence.

Laws
This agreement shall be governed by the laws of The People's Republic of China . Any action related to this agreement must be brought in the PRC, and user irrevocably consents to the jurisdiction of such courts. If any provision(s) of this Agreement is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

The user and Mandarinrise.com agree that any cause of action arising out of, or related to, this service must commence within one year after the cause of action arose; otherwise, such cause of action is permanently barred.

The section titles in this Agreement are solely used for the convenience of the parties and have no legal or contractual significance.
